1. Acceptance of Terms

By accessing our website or engaging Echt Tech Consultancy Services Pvt Ltd for any technology services, custom software development, digital marketing, website design, staff augmentation, or IT consultation, you confirm that you are at least 18 years of age and possess the legal authority to enter into a binding legal contract on behalf of yourself or the entity you represent.

2. Services & Scope of Work

Echt Tech Consultancy Services Pvt Ltd offers specialized IT solutions, including custom web application development, mobile application development, digital marketing (SEO, PPC, SMO), IT infrastructure consulting, process optimization, and staff augmentation services.

The specific deliverables, milestones, timelines, and fees for any project or service engagement shall be specified in a separate Statement of Work (SOW), Proposal, or Master Services Agreement executed between Echt Tech Consultancy Services Pvt Ltd and the Client.

3. Intellectual Property Rights

All website content, visual designs, brand assets, source codes, graphics, documentation, software tools, and underlying materials displayed on http://www.echttech.com are the exclusive intellectual property of Echt Tech Consultancy Services Pvt Ltd and protected by applicable copyright, trademark, and trade secret laws.

For client engagements, upon receipt of full and final payment, Echt Tech Consultancy Services Pvt Ltd grants the Client full ownership rights to the custom software code or digital assets specified as client deliverables in the relevant Statement of Work. All pre-existing frameworks, reusable components, or internal tools remain the property of Echt Tech.

4. User Conduct & Acceptable Use

You agree to use our website and services only for lawful purposes. You are strictly prohibited from:

• Engaging in unauthorized access, hacking, probing, or testing the vulnerability of our servers or networks.
• Transmitting malware, viruses, trojans, worms, or any malicious code.
• Scraping, harvesting, or extracting data from our website without prior written authorization.
• Impair, overburden, or disrupt the integrity or performance of our website or IT infrastructure.

5. Payment Terms & Invoicing

Clients shall pay all fees and charges in accordance with the payment schedules, milestones, and currency specified in the relevant invoice or Statement of Work.

Invoices are due upon receipt unless explicitly specified otherwise. Late payments may be subject to interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower. Taxes applicable under Indian law (including GST) shall be charged extra as per statutory rates.

6. Client Obligations & Cooperation

Timely project execution depends upon the active cooperation of the Client. The Client agrees to provide prompt access to required project requirements, feedback, brand assets, server access, and approvals. Echt Tech Consultancy Services Pvt Ltd shall not be responsible for project delays caused by client inaction or delayed approvals.

7. Warranties & Disclaimers

While Echt Tech Consultancy Services Pvt Ltd strives to deliver state-of-the-art software solutions and high-quality consulting services, our website and uncontracted public informational materials are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

For client engagements, specific performance warranties and bug-fix warranty periods (e.g. 30-day post-launch warranty) shall be defined in the formal project agreement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Echt Tech Consultancy Services Pvt Ltd, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business interruption arising out of or in connection with the use of our website or services.

In all cases, the aggregate liability of Echt Tech Consultancy Services Pvt Ltd for any claims arising under these Terms shall not exceed the total fees actually paid by the Client to Echt Tech for the specific service giving rise to the claim during the three (3) months preceding the event.

9. Confidentiality & Non-Disclosure

Both parties agree to hold in strict confidence all proprietary data, business plans, technical code, customer records, and commercial information disclosed during the course of engagement. Neither party shall disclose confidential information to any third party without prior written consent, except as required by law or to authorized service providers under NDA.

10. Termination & Suspension

Either party may terminate a service agreement for cause upon thirty (30) days written notice if the other party breaches a material obligation and fails to cure such breach within the notice period.

Upon termination, the Client shall pay Echt Tech Consultancy Services Pvt Ltd for all work completed and expenses incurred up to the effective date of termination.

11. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of India, without regard to its conflict of law principles.

Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts located in India.

12. Modifications & Contact Information

Echt Tech Consultancy Services Pvt Ltd reserves the right to amend or update these Terms and Conditions at any time. Any changes will be posted on this page with an updated effective date. Continued use of our website following any updates constitutes acceptance of the modified Terms.
